Terms and Conditions (Australia & New Zealand):

  1. The Brand USA – USA Discovery Program incentive is open to all Australian and New Zealand travel agents over the age of 21. This includes reservations, retail, and call centre staff, as well as home-based agents, all operating in the business of leisure travel to the United States of America.

  2. The USA Discovery Program incentive is operated by Brand USA, 1725 Eye Street, NW, Suite 800, Washington, D.C. 20006, USA; and managed by their Australian & New Zealand representative agent Gate 7 Pty Ltd, Suite 102, 13–15 Wentworth Avenue, Sydney NSW 2000.

  3. The incentive period is open from 12 November 2024 and will close at midnight AEST on 15 January 2025.

  4. Applicants must hold silver status by completing destination training or retaining via the USA Discovery Program to be eligible to win. Australian agents must complete training or retaining at www.usadiscoveryprogram.com.au and New Zealand agents must complete training or retaining at www.usadiscoveryprogram.co.nz

  5. Agents will receive an entry into the incentive draw for each USA booking with Delta Air Lines where passengers are traveling from Australia or New Zealand to mainland USA.

  6. Each Discover Alamo badge trained or retained in the Partner Specialisation, Getting Around chapter will gain participants an entry into the incentive draw.

  7. Agents who make Infinity Holidays land bookings to the United States of America will receive double entries into the incentive draw. Sales report will be provided to Brand USA by Infinity Holidays at the conclusion of the incentive campaign.

  8. Applicants must be aged 21 or over. All entrants must hold a valid passport, with at least 6 months validity and a valid ESTA.

  9. Confirmed participants are fully responsible for arranging their own visa or necessary requirements to enter the USA.

  10. Allocation of places will be based on completion of the entry criteria and nature of the agent’s core business.

  11. Allocation of places resides with Brand USA. All decisions are final.

  12. Participants will be confirmed by 24th January 2025 for travel on the prize famil departing on Friday 28th February 2025 and returning from the United States of America on Saturday 8th March 2025. Winners must confirm their participation by the 31st of January 2025, or an alternative winner will be selected.

  13. Winners of this famil opportunity will agree to create and share social media content as outlined in the itinerary.

  14. Winners of this famil opportunity will have a full licence from either Australia or New Zealand and the necessary requirements to drive a motor vehicle in the USA.

  15. Winners will be given the opportunity to drive during this famil and will need to ensure their travel insurance has motor vehicle coverage included.

  16. All agents allocated a place on the USA Discovery Program incentive will be required to sign a Liability Waiver form and Model Release Waiver prior to departure from Australia / New Zealand.

  17. All confirmed incentive participants will receive accommodation, meals and activities as per itinerary.  All other costs incurred are the responsibility of the agent including any visa fees and travel insurance for the trip.

  18. Confirmed incentive participants may be required to stay in shared accommodation, arranged by Brand USA.

  19. All data gathered from entrants, including email addresses, will be used to contact the person regarding participation in the USA Discovery Program incentive. Confirmed participants agree to their email address being shared with the suppliers of the itinerary (Hotels, attractions etc).

  20. Brand USA accepts no liability for your use of this website. Brand USA will handle your personal details according to the Brand USA Privacy Policy on www.visittheusa.com/info/privacy-policy

  21. The content and information displayed on this website (‘www.USADiscoveryProgram.com.au or www.USADiscoveryProgram.co.nz’ or the ‘Site’) is the property of the Corporation for Travel Promotion, doing business as Brand USA. The downloading, reproduction or retransmission of the Site, other than for non-commercial individual use, is strictly prohibited.

  22. www.USADiscoveryProgram.com.au or www.USADiscoveryProgram.co.nz may contain or reference trademarks, patents, copyrighted materials, trade secrets, technologies, products, processes or other proprietary rights of Brand USA and/or other parties. No license to or right in any such trademarks, patents, copyrighted materials, trade secrets, technologies, products, processes, and other proprietary rights of the Site or of Brand USA and/or other parties is granted to or conferred upon you without the express written consent of Brand USA.

  23. Brand USA is providing information and services on the Internet as a benefit and service in furtherance of Brand USA’s non-profit and tax-exempt status. Brand USA makes no representations about the suitability of this information and these services for any purpose.

  24. You agree that you will not use any device, software or other instrumentality to interfere or attempt to interfere with the proper working of our Site, and that you will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure. In addition, you agree that you will not use any robot, spider, other automatic device or manual process to monitor the Site or copy our web pages or the content contained herein, without the prior express consent from an authorised Corporation for Travel Promotion representative (such consent is deemed given for standard search engine technology employed by Internet search websites to direct Internet users to this Site).

  25. This Site provides you with the ability to use usernames, passwords or other codes or devices to gain access to restricted portions of this Site (‘access codes’). The content contained in such restricted areas is confidential to Corporation for Travel Promotion and is provided to you for your business use only. We reserve the right to prohibit the use of such access codes on your behalf by third parties where we determine that such use interferes with our Site’s operation or is detrimental to Brand USA.

  26. All www.usadiscoveryprogram.com.au or www.usadiscoveryprogram.co.nz information is provided ‘as is’ without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose or non-infringement. Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.

  27. With respect to all communications you make to Brand USA regarding www.USADiscoveryProgram.com.au or www.USADiscoveryProgram.co.nz information, including but not limited to feedback, questions, comments, suggestions and the like: (a) you shall have no right of confidentiality in your communications and Brand USA shall have no obligation to protect your communications from disclosure; (b) Brand USA shall be free to reproduce, use, disclose and distribute your communications to others without limitation; and (c) Brand USA shall be free to use any ideas, concepts, know-how, content or techniques contained in your communications for any purpose whatsoever, including but not limited to the development, production and marketing of products and services that incorporate such information.

  28. The www.USADiscoveryProgram.com.au or www.USADiscoveryProgram.co.nz information may contain technical inaccuracies and typographical errors. Brand USA shall not assume responsibility or liability for any such inaccuracies, errors or omissions, and shall have no obligation related to information affected by such inaccuracies. Brand USA reserves the right to make changes, corrections, cancellations and/or improvements to www.USADiscoveryProgram.com.au or www.USADiscoveryProgram.co.nz, and to the products and programmes described in such information, at any time without notice, including after confirmation of a transaction.

  29. Passwords. If we have provided you with a unique password, one of its purposes is so that access to information related to you and your company can be restricted to only those individuals to whom you provided the password. It is your responsibility to protect the confidentiality of the password. Brand USA assumes no liability for any access to information that is executed with the password provided to you. We strongly recommend that you change the password on a periodic basis and whenever you suspect that knowledge of the password is no longer limited to those that you have authorised.

  30. This is an Australia and New Zealand website and is subject to Australia and New Zealand laws. Brand USA will disclose any information regarding the use of this Site, including personal information pertaining to you without your permission when required by law, or in good faith belief that such action is necessary to investigate or protect against harmful activities to Brand USA, its associates, or property (including this Site), or to others.

  31. No Arrangements for Prohibited Persons – Brand USA is a United States company and is prohibited from providing services to certain ‘prohibited persons’ that are government officials or residents of certain embargoed countries, or terrorists or drug traffickers whose names are published on lists maintained by the United States Department of Treasury. You agree to use all reasonable efforts not to arrange travel for any of these prohibited persons and understand that doing so is grounds for termination from participation on the Site.

  32. If you choose to leave this Site via links to other non-www.USADiscoveryProgram.com.au or www.USADiscoveryProgram.co.nz websites, including those of advertisers, Brand USA is not responsible for the privacy policies of those sites or the cookies those sites use. In addition, because Brand USA has no control over such sites and resources, you acknowledge and agree that Brand USA is not responsible for the availability of such external sites or resources and does not endorse and is not responsible or liable for any content, advertising, products or other materials on or available from such sites or resources.

  33. Employees and their immediate families of the Promoter, Partners, Agencies and their related corporate bodies, are not eligible to enter this promotion.

  34. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry that is not in accordance with these Terms & Conditions.

  35. The prize is non-transferable or exchangeable.

  36. The Promoter reserves the right to redraw in the event of a Winner/s not claiming any Prize. If any Prize remains unclaimed or forfeited through ineligibility or otherwise, the Promoter will conduct further draw/s, as required. The winner/s, if any, will be notified in writing and by phone within 2 business days of the redraw/s.

  37. By participating in this Promotion, entrants consent to the storage of their entry information on the databases of the Promoter, its related bodies and all Partners involved in this Promotion.

  38. The Promoter collects information about entrants, including names and contact details that entrants provide when participating in this Promotion. The Promoter collects and uses that information to provide opted-in entrants with targeted advertising, for the purposes described in the Promoter’s Privacy Policy and for any other purposes, described at the time of collection. The Promoter may disclose entrant information to related companies, including those located outside Australia, who may contact entrants by email, mail, phone and SMS, at any time. Further information about how the Promoter handles personal information, how opted-in entrants can complain about any breach of the Australian Privacy Principles, how The Promoter will deal with a complaint of that nature, how opted-in entrants can access or seek correction of any personal information and The Promoter’s contact details in connection with this promotion will be handled in accordance with the Promoter’s Privacy Statement.
